Divorce – Where Do I Start?
Every divorce is unique and the number and complexity of issues can greatly vary. Starting the process can be overwhelming and stressful, but it doesn't have to be. We help by providing a roadmap and navigating you through the journey every step of the way.
The Steps
Educate & Decide
The first step is to meet with us and allow us to put you at greater ease. We will:
- Identify the issues in your case
- Explain the complexity of the issues
- Discuss your options
- Develop a plan of action to proceed forward that is in your best interest
We explore all of the options to determine how best to proceed to minimize stress, time, and fees. Our goal is to resolve divorces amicably, expediently, and in a manner that is more cost effective through mediation or by trying to settle through direct communications with your spouse (if self-represented) or your spouse’s attorney. Considering our understaffed court system a private judge often saves time and money, provides for more confidentiality, and allows for hearings in more comfortable settings. If litigation is the best option, you will have the confidence of knowing we consider the courthouse our "other office", as we are frequently there.
Gather Information
Together, we will identify and gather information needed to proceed.
Handling Initial Court filings
To commence any divorce, a Petition for Dissolution of Marriage must be filed with the court by one spouse. A Response is filed by the other spouse. In addition, either party may file a Request for Orders at that time or later on, for relief such as temporary custody orders and support, pending final resolution at trial or by settlement. We will get you started with necessary initial court filings.
Law of Divorce in a Nutshell
The overall principles of divorce are simple, although their application can be extremely complex. Here are the basic principals in a nutshell:
